This website is governed by legislation exclusively applicable in Spain, and both Spanish nationals and foreigners who use this website are subject to it.

Access to our website by the USER is free and subject to the prior reading and express unreserved acceptance of the TERMS & CONDITIONS OF USE in force at the time of access, please read this document carefully. The user when using our website, its contents or services, accepts and is expressly subject to the general conditions of use. If the user does not agree to these terms of use, they should refrain from using this website.

At any time, we can modify the presentation and configuration of our website, expand or reduce services, even remove it from the network, as well as the services and content provided, all unilaterally and without notice.

INTELLECTUAL PROPERTY

All contents, text, images, and source code are owned by MICHELLE WORGAN or third parties who have acquired rights to use them, and are protected by Intellectual and Industrial Property rights.

The user is only entitled to a private use thereof, not for profit, and needs the express authorization of MICHELLE WORGAN and/or the holder of the rights in order to modify, reproduce, exploit or distribute them or any right belonging to the owner.

CONDITIONS OF ACCESS

Access to our website is free and requires no subscription or registration. 

Sending personal data constitutes acceptance by the USER of our privacy policy.

The user must access our Website in good faith, in accordance with rules of public order, and these General Conditions of use. Access to our Website is at the user’s own and exclusively liability, and the user shall be liable for any damages he/she causes to third parties or to us.

Taking into account the impossibility of control with regard to information, contents and services contained by other websites to which access may be obtained through the links that our website makes available to you, we inform you that MICHELLE WORGAN is released from any liability for damages of any kind that may derive from the use of these websites unrelated to our company by the user.

GENERAL

Comments and complaints

While we make every effort to maintain high standards and provide high-quality experiences for all clients, you may want to offer comments or make a complaint. At the end of every course you will be given the opportunity to provide feedback through our evaluation form, but if you feel this is not sufficient, you may wish to make a formal complaint. Note that all complaints should be made in writing, and we ask that you notify us within ten working days of the end of your course.

Spanish Law

The contract between you and MICHELLE WORGAN is governed by Spanish law.

Changes to terms

We reserve the right to change or modify these Terms including for legal, regulatory or security reasons at any time. Whilst we will flag changes on the Website and/or send emails in relation to major changes, it is your responsibility to check the Terms for changes. If you have any questions, concerns, or comments about our Terms please contact us.

ONLINE COURSES TERMS & CONDITIONS

When booking an online course through www.michelleworgan.com, you agree to the following terms and conditions.

Cancellations & refunds

You may cancel your booking and have all fees paid returned to you for the first 10 days after payment.

Following this initial 10-day period, cancellations of bookings will not be accepted unless we are able to fill your place from a waiting list.

If the course has already begun, we do not offer refunds once one third (33.3%) of the course has been completed. In the case of courses of six weeks’ duration, this period ends after the Week 2 live session.

Please note that if you leave the course after this period or if you fail to attend all or any part of the course, no refund will be made and we will retain 100% of your payment.

In the unlikely case that a course must be cancelled, we reserve the right to do so up to 48 hours before the start date. In this case your full course fees will be refunded.

Bookings

You should not consider your booking as definite until you receive an automated notification that your payment has been processed and the order is complete. 

Follwong this, you will receive a questionnaire in your inbox which you must complete within 5 days of its reception. You will then receive an email with more information about the course logistics.

Deposits

If you have made a deposit for any of the courses, you will be entitled to finalise your booking in an early booking period. You will receive an email with instructions on how to proceed. The deposit does not guarantee your place on the course once standard booking are open since places will be filled on a first come first serve basis. If you choose not to complete your booking, please inform us and request a refund.

Deposits are fully refundable.

Conduct and safety

Our online courses rely on a supportive environment that depends on tolerance and understanding of all participants and tutors and their work. We therefore ask that you are thoughtful and respectful of the other participants and help foster an atmosphere conducive to creativity and sharing. We reserve the right to refuse a place and / or to exclude from a course any participant who behaves in an abusive or disruptive manner or engages in any discriminatory conduct. No refund will be given if exclusion is made for these reasons.

RESOURCE PACKS TERMS & CONDITIONS

When purchasing a resource pack or bundle through www.michelleworgan.com, you agree to the following terms and conditions.

Refunds

No refunds are available for digital downloads such as resource packs. Please read the description and the product preview carefully before buying.

Limited Rights to Use Content

All materials and resources belong to MICHELLE WORGAN at www.michelleworgan.com.

You may display any resources on a computer screen or mobile device, electronic or interactive whiteboard, print on paper and store such pages in electronic form for your own personal, educational, non-commercial purposes.

Most of the content on the Website is owned by MICHELLE WORGAN, but certain content is used under licence from third parties (‘third party content’) and will be marked with the copyright notice of those third parties. Some of the third party content will be subject to additional restrictions. The relevant copyright notice will make it clear where that is the case and you must comply with such restrictions. Every effort has been made to trace all the copyright holders, but if any have been inadvertently overlooked, MICHELLE WORGAN will be pleased to make the necessary acknowledgements at the first opportunity.

MICHELLE WORGAN’s status (and that of any identified third party Contributors) as the authors of content on the Websites must always be acknowledged.

You may not (without prior written permission from MICHELLE WORGAN):

  1. redistribute, share or supply any of the content to other people or third parties. For the avoidance of doubt, you cannot redistribute, share or supply any of the content which you have purchased as an individual other than in the course of your teaching profession;
  2. remove the copyright or trademark notice from any copies of content made under this agreement;
  3. create a database in electronic or structured manual form by systematically downloading and storing all or any of the content;
  4. except as expressly set out above, modify, reproduce or in any way commercially exploit any of the content.

Purchases & Downloads

You will receive an automated download notification once your payment has been processed. If you do not receive this, please contact enquiries@michelleworgan.com.
